Warrantly and Return Policy

Warrantly (abridged)

Net 30 days, unless otherwise specified in Fabtech ID’s quotation accepted by the Buyer.

2. Interest charges

2% per month (24% per annum) on all overdue invoices.

3. Minimum fees

$20 net before taxes.

4. Price

All prices are quoted in the currency specified in Fabtech ID’s quotation accepted by the Buyer. Notwithstanding any provision to the contrary, all prices are subject to change without notice. All orders are subject to the prices indicated in the sales bulletin. Prices exclude insurance, taxes, shipping and handling and other charges.

5. Shipping conditions

Unless otherwise stipulated in the sales bulletin, deliveries will be made EXW Fabtech ID, warehouse, Chicoutimi, Canada (Incoterms 2020) Products will be considered delivered when they are made available to the Buyer at the place indicated above . The risk of loss of the Products shall pass to the Buyer upon delivery. Ownership of the Products shall pass to the Buyer once the Products have been effectively paid for to Fabtech ID.

6. Order cancellation

Orders for customized or special products or products that are not part of our inventory and/or products approved by the Buyer cannot be cancelled..

7. Other conditions

“Contract” means collectively (i) these conditions (ii) the General Conditions of Sale of Products, a copy of which is reproduced at this URL :  https://www.fabtechid.com/en_CA/ConditionsGenerales (or any successor to such URL) (“General Conditions”) and (iii) Fabtech ID’s quotation, sales bulletin and invoices accepted by Buyer, in each case, as supplemented, amended, restated or replaced from time to time by mutual consent of the parties. The General Terms and Conditions are deemed incorporated by reference and form an integral part of this Agreement as if fully included in the text of this Agreement.

BY PLACING AN ORDER FOR PRODUCTS, YOU REPRESENT THAT YOU ARE OF LEGAL AGE TO ENTER INTO THIS AGREEMENT, AND YOU ACCEPT AND ARE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. YOU AFFIRM THAT IF YOU ARE PLACING AN ORDER ON BEHALF OF AN ORGANIZATION OR COMPANY, YOU HAVE THE LEGAL AUTHORITY TO BIND SUCH ORGANIZATION OR COMPANY TO THE TERMS OF THE AGREEMENT. YOU MAY NOT ORDER OR OBTAIN PRODUCTS IF YOU: (I) DO NOT ACCEPT THE TERMS OF THE AGREEMENT; (II) ARE UNDER THE AGE OF MAJORITY IN YOUR PROVINCE/STATE OR TERRITORY OF RESIDENCE; OR (III) CANNOT ACCESS OR USE THE PRODUCTS UNDER APPLICABLE LAW.

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, negotiations and discussions with respect to the subject matter hereof, whether oral or written..

All matters arising out of or relating to this Agreement shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without giving effect to any conflict of laws provision. All proceedings of any nature whatsoever relating to this Agreement shall be brought in the courts of the Province of Quebec, and each party irrevocably submits to the exclusive jurisdiction of such courts..

Each party declares that it has carefully read and examined this Agreement, and its contents are understood by that party, including the General Terms and Conditions.

RETURN POLICY

Buyer’s Liability
  • Inspection upon Receipt: All products must be inspected immediately upon receipt. The buyer must check for compliance with the order, that there is no damage, and that the correct quantity was received.
  • Mandatory notification: Any problems (such as damaged, non-compliant, or missing items) must be reported to us in writing at commandes@fabtechid.com within 30 days of the delivery date. No claims will be accepted after this period.
  • Order accuracy: Orders must be verified before confirmation. The buyer is responsible for ensuring that the product specifications (models, quantities, dimensions, etc.) meet their needs, especially for customized or made-to-measure products.
Fabtech ID’s Liability
  • Defective Products: Fabtech ID undertakes to repair or replace any defective parts, at its own expense, after inspection.
  • Refund: If repair or replacement is not possible, we will refund the purchase price of the defective product.
  • Compliant Products: No returns or refunds will be accepted for products that comply with the original order specifications.
Return Policy

1. Authorization Required:

  • All returns must be authorized by Fabtech ID in advance. Unauthorized returns will be refused.
  • A return request must be submitted in writing, with a detailed description of the reason for the return and, if applicable, include supporting evidence (photos or documents).

2. Return Deadline:

  • Returns must be made within 30 days of the delivery date. After this period, no returns will be accepted.

3. Conditions for returns:

  • Compliant products: Returns of products that comply with the initial order are not accepted.
  • Defective products or Fabtech ID errors: If the return is due to an error on Fabtech ID’s part (such as an incorrect or defective product, etc.), the total amount invoiced will be credited, or the product will be replaced at no additional cost.

4. Return fees:

  • Warehouse restocking fee: For any accepted return of a non-defective products (exceptional cases), a 20% warehouse restocking fee will be applied for handling.
  • Shipping costs: Return shipping costs are the responsibility of the buyer, except in cases of error attributable to Fabtech ID.

5. Customized or Made-to-Order Products:

  • No returns or refunds are possible for these products, except in cases of proven defects or manufacturing errors.
Exclusions from Liability
  • Fabtech ID cannot be held liable for damage resulting from the buyer’s or a third party’s misuse, installation, or handling of the products.
  • Returns due to a change of mind, misinterpretation of specifications, or incompatibility with existing equipment are not accepted.
Procedure for Authorized Returns
  1. Submit a return request: Contact us in writing to obtain a return authorization, including order details and reasons.
  2. Receive an authorization notice: After reviewing your request, our team will either provide you with a return authorization notice or deny your request.
  3. Ship the products: Products must be returned in their original packaging with a copy of the invoice.
  4. Inspection and processing: An inspection will be carried out upon receipt of the products. Refunds or replacements will be issued according to the terms of this policy.
